First Reading, Ordinance No. 2026-2340: Duke Energy Franchise Agreement Renewal
First reading of an ordinance granting Duke Energy Florida, LLC an electric utility rights-of-way utilization franchise, replacing the 1996 franchise agreement (Ordinance 1402) which expires July 16, 2026. The new agreement has a 15-year initial term with two 5-year renewals, maintains a 6% franchise fee, and modernizes provisions on indemnification, audits (every 3 years), pole abandonment, and dispute resolution.
Ordinance No. 2026-2340 Approval of the first reading of ordinance 2026-2340 is recommended.

First Reading, Ordinance No. 2026-2350 RE: Amendments to Utility Ordinance
First reading of an ordinance amending Chapter 24, Article II of the Code of Ordinances pertaining to utility services. Key changes: (1) transitions utility accounts to property-owner-only model, eliminating tenant accounts (with 1-year transition); (2) establishes rate administration framework where rates/fees are set by Council resolution rather than ordinance; (3) revises utility deposits to be held in non-interest-bearing accounts.
Ordinance No. 2026-2350 Motion to approve on first reading.

Second Reading, Ordinance No. 2026-2364: Amendments to Chapter 23, Code of Ordinances RE: Transportation Devices
Second and final reading of an ordinance adding Article IV to Chapter 23 regarding transportation devices. Prohibits transportation devices in Railroad Square Transportation Device Exclusion Area, prohibits reckless operation citywide, and prohibits transportation devices (other than bicycles) in city parks, with exceptions for designated areas, ADA users, and special events.
Ordinance No. 2026-2364 Staff recommends that the City Council conduct a second and final reading of Ordinance No. 2026-2364.

Request to Waive Fees for 2025 Cotee River Bikefest
Consideration of a request from Tina Farrell, President of Farrell Cares, Inc., to waive special event fees of $10,285.76 for the 2025 Cotee River Bikefest, citing precedent of the council's March 3, 2026 waiver of $35,383.88 in fees for the 2025 Chasco Fiesta.
$10,285.76 The recommendation is for the City Council to consider this matter and decide in the best interest of the city.

Request to Enter into an Infrastructure Agreement with NPR Grand 1, LLC RE: Villa del Sol Project
Authorization for the City Manager to enter into an Infrastructure Agreement with NPR Grand 1, LLC committing the city to install an 8-inch reclaimed water line to the Villa del Sol project site at 5637 Marine Parkway within 12 months of the effective date.
The recommendation is to authorize the City Manager to enter into an agreement with NPR Grand 1, LLC with respect to the Villa del Sol project.

ITB26-019 Plunge Pool and Dive Pool Resurfacing Bid Rejection
Staff requests rejection of the sole bid received from AuMiller Pools LLC ($192,383) for the Plunge Pool and Dive Pool Resurfacing project and authorization to re-advertise the ITB to increase competition.
$192,383 Rejection of the bid is recommended.

ITB23-007 Fire Station No. 2 Relocation Project Close-Out
Project close-out for the Fire Station No. 2 relocation, including a deductive change order of ($706,017.08) and final pay request not to exceed $203,880.96 to E&L Construction Group Inc. The project was 672 days past contracted term; 357 days deemed unwarranted, resulting in $535,500 in liquidated damages assessed at $1,500/day.
