    The second reading of these ordinances are available. So would you like to start out with that? Yeah, I'd be more than glad to, Mr. Mayor. It is a pleasure to have a discussion this evening with you this evening on ordinances related to the proposed villa del sol project, a project which I. I like to indicate to you that we've been talking about now for over four years. It is an exciting project, and one in which. Has been brought about by the fact that the HCA Community Hospital vacated its home on Grand Boulevard back in 2012, which as as indicated, was located on Grand Boulevard, just at the marine parkway and george street intersection. They housed 160 bed facility there at the time. And what is proposed there now is $150 million project, which represents roughly 300 apartments and 153 residential single family homes, on what is a 24 acre site of property. The CRA agreement, which was presented to you back on September 11th of 25, will be back before you at your second meeting in. Next second meeting in may, but we'll be conducting first readings tonight on ordinances related to vacations of some public right of ways. And we'll also conduct second readings on those tomorrow evening. You may be wondering why we're we're doing it that way. Since the discussions related to this development have spanned such a long period of time, the property owner, which is HCA Community Hospital, has grown a little bit impatient with the developer and has asked him to speed things along to closure so that they can close on the real estate sale of the property, which will enable them to formally go forward with their their closing, and the developer will then become the formal owner of the property and be able to commence with the construction drawings and the initiation of the construction process on the redevelopment of of this site. And we're very anxious for, for that to occur as it's a first rate development, and it will be a real compliment to the city's housing stock. With that being said, I can respond to any questions that you may have of me. If not, I'll turn over the first reading to the city attorney for the ordinance and then Mr. Hall for a presentation on the vacation. This ordinance, number 2026 2356, an ordinance of the city of New Port Richey, Florida, providing for the vacation of a portion of the right of way known as High Street, running between aspen street and Grand Boulevard. Providing. That said, right of way is as dedicated in the plat of rush brothers palm haven. Addition to New Port Richey. Recorded in plat book two, page 11 of the public records of Pasco county, Florida, as depicted in the plat of sea craft subdivision recorded in plat book two, page [00:05:02] 62 of the public records of Pasco county, Florida, providing for conditions of approval, providing for severability and effective date. In respect of everyone's time. What I've done is I've put all of these presentations, all of these four ordinances into one powerpoint, and it'll make more sense because it shows how they all fit together. You will have to vote on these all individually. However, you'll see in the presentation how this all fits together. The applicant's request is actually for items High Street, located between Grand Boulevard and aspen street, the east side of Grand Boulevard. Water Street between Grand Boulevard and High Street, and then conveyance of a surplus property that's in the right of way of Grand Boulevard. These are the same vacations and items that you've seen High Street previously. This will be, I think, the third time. And then the other ones you saw recently. And the reason why we're seeing it again this evening is revisions to the surveys, inaccuracies in the survey. So we wanted to make sure to, you know, make sure that all of these items are exact and you vote on them appropriately. When the applicant asked for this, they're stating that the parcels are part of the approved plan submitted with zoning, and they are necessary to create a cohesive site so they can begin the plat process. And then subsequent, as miss man say, begin site construction permit drawings. What you have here is the drawing of villa del sol that was included in the zoning when it went through several years ago. And what I've highlighted here in the red area is the focus area where all of these right of ways and the surplus properties exist. They're all up in that upper portion of the property. Now, the little yellow rectangle that we have is city acquisition property that I'll explain as we go through this. Specifically, the red area is High Street area one. That's one ordinance. The second ordinance is a portion of Grand Boulevard. The red section. The third ordinance is the portion of water street to be vacated, which is the blue area. And last but not least, the green area is the surplus city property, a remnant parcel, small remnant parcel that is asked that has been asked for also to be deeded to the developer. Now, the yellow rectangle that I showed you is something that's included in this ordinance where it. This is where the fire station is when the when the developer acquires the property has title to the property, they will deed this portion of land. It's a very small parcel of land back to the deed that. To the city and will become part of the fire station driveway area. The ordinance has several conditions to it. I'll speak of them in a cursory manner, and if there's more questions, Mr. Driscoll can go into that. But there are three three separate ordinance conditions. There's title conditions, which basically says the developer gets the right of way and the surplus property, and we get the fire station parcel that's included. There are development conditions, which basically sets up within 36 months vertical construction, utilities and building foundations need to be started by the developer. And then it it could potentially become considered abandoned if the developer has no inspections on active permits within one year. And the reason why, and that's shown within the red area, that red area is again, which is the northern parcel that the reason why we did that is for the reversion clause. If by chance, those items in the development agreement aren't met, then the property reverts or could revert back to the city if there's no development activity. So we want to maintain that ability to to have that those parcels. That's it in a nutshell. There's four ordinances. You'll hear, and I can answer any further questions you may have. Mr. Mayor, I do recommend you open up to the public on each of these ordinances. So the first ordinance is will deal with this, a first reading of ordinance number 2026 2356. Vacation of the right of way for High Street. Do you have any public comment? Seeing no [00:10:05] One come forward, bring it back for discussion and vote. For approval. I'll second. I'm good. No, I think dale did a great job explaining it. I think it just it makes total sense. I just have one question. I know you brought up the reversion clause and you mentioned that the project would have to get underway. If I'm reading the revised agreement. It also requires that a certificate of occupancy be issued on those. So my if that's correct, I would have to ask if you want to make sure they get a building permit and that it's active and they're underway, how how in the world would it work for the city to continue to have. An interest in something that might have structure on it to get it back? That sounds tricky to me from coming from a family of lawyers. Yes. So the version that we handed out tonight does change the conditions. So that's the main reason for the changes. Actually, we had a conference call with the developer's attorneys today and other people involved in the development. And we came to the new language, which is the two conditions that dale laid out. One is that they begin vertical construction just in that upper corner, where the right of ways are within 36 months. The second condition is that they continue that construction, basically by ensuring that there's at least a building inspection every one year period. So if they go longer than one year without having an active permit and getting inspection, then if those events, if either of those events occur, the city could take back the property. That's all it says. So we've taken into account the fact that, yes, there's going to be a point at which there's going to be a building or something constructed on the road. We're not getting that road back. So we're mindful of that. We just want them to have some responsibility. So if for some reason this project never takes off at all, we can take back those roadways. Yeah, that was my concern. And that's. Thank you. All those in favor signify by I, I that's for nothing. First reading of ordinance number 2026 2357. Vacation of right of way on Grand Boulevard. This is ordinance number 2026 2357, an ordinance of the city of New Port Richey, Florida, providing for vacation of a portion of the right of way known as Grand Boulevard along the southeast boundary line of said right of way providing. That said, right of way is as depicted in the public records of Pasco county, Florida, providing for conditions of approval, providing for conflict, severability and an effective date. Any public comment seeing no one come forward, bring it back for discussion and vote. I'll move to approve. I'll make the second maker. No. I'm good. Second, no, I'm in agreement. It's not a whole lot of property either. And we've had the deal explained to the benefit of the city. So thank you. And just for the record, all of the vacation ordinances have the same conditions. I suspect ordinance number 2026 2358. An ordinance of the city of New Port Richey, Florida, providing for the vacation of a portion of the right of way known as water street, running between Grand Boulevard and High Street and dedicating the plat of rush brothers palm haven. Addition to New Port Richey. Any public comment. Lisa Tinker 7017 Park Drive. I just have a question. I had to pull up my map to make sure I was correct. Water street is on the opposite side of Grand Boulevard. No, it's on the north side of that lot that he showed you. Yeah. If I, if I may. Water street is also on the north side of Grand Boulevard. We are not that. This is not in reference to that portion. There's a very small portion that's on the south side of Grand Boulevard that dead ends in the High Street. It was. I forgot what color it was. I could bring it up and show it, but that's the portion. It's south of Grand Boulevard. I've one more question. I live in off of north river road and driving past the apartment complex that is finally finished, that had been sitting there for a decade. [00:15:04] Do we have some sort of guarantee that if this is going to end up sitting here for a decade, two decades just got finished. Just we just got through saying that we get we get permits. Yeah, we have we can get a property back. But is there any penalty against the contractor who's going to let it sit to lose the property? All those in favor signify by I, I, I, I, we have a motion. Just once comments are made about projects which I was involved in, which is the main street landing project. And just as a comment, because I know that there's been some ruckus among the facebook world or the social media world about this and the and the rush to do this. And it was already expressed how long it's been since the city council approved this project. So these are adjustments that are made at the end of this approval. And I think the council has heard a lot of information from residents about the importance of transportation and traffic, of making improvements, making sure this project works. But as to the main street landing project, the developer in that project had come to the city with a workout, and that was turned down by the city by a 3 to 2 vote because it didn't. Some of the members of the council didn't like the look of the building, or the fact that it came out to the street that was which was following main street theory. So I think what we probably need to make sure we do is, is as we go forward, having more outreach to the public about our our redevelopment efforts, because we're the city council tonight. And so we're doing the work of the city council to let this project go through the incentives, all the things that are all being discussed as being over, coming from taxpayer money. It's coming from the taxpayer money that's created by the project. And so when things are put out that somebody's taking your money as a taxpayer and using it to give to a developer, these are incentives that are just not well enough. Understood. But that's not the purpose of tonight's thing. Thank you for giving me some leeway, Mr. Mayor, but I think we need a better understanding community wide about how all of these things work. I'm good, I'm good.

    First reading of Ordinance 2026-2359 authorizing the sale of a surplus triangular city property at the intersection of Grand Boulevard and High Street. The City Attorney clarified that this ordinance contains conditions requiring the developer to obtain title to surrounding properties and convey the area in front of the fire station to the city, but lacks reverter provisions used in the related vacation ordinances. The motion to approve passed unanimously on voice vote.

Mr. Mayor, before you vote, I just want to make sure that you understand that this particular ordinance has different conditions than the others. The others all required that the developer obtain title to all the surrounding properties and give us title to the area in front of the fire station. This ordinance has those conditions, but it doesn't have the reverter provisions that are more necessary in the vacation situation than they are. This is truly a surplus triangle of property that the city would have no use for and just creates, quite frankly, liability responsibility.
