The present use is convenience store with fuel sales and retail establishment and the proposed development request is to install a 50 square foot monument sign. [00:20:56] The specific request is a variance to reduce the minimum setback from the right-of-way from 15 foot to 5 foot off of U.S. Highway and Bellevue Avenue. The land use development code states that no sign shall be placed within 15 feet of the right-of-way and it gives the LDRB the authority to grant a variance of 5 feet. [00:21:25] The reason why it's before the city council tonight is because the request is greater than that. They want to actually have a 10 foot variance which brings it to a 5 foot setback from the two roadways. This is the overall location map where it's located. You can see that U.S. Highway 19 is to the left or the west and to the north is Bellevue Avenue. If you see below that midway or probably a third of the way on the west side, the left side of the drawing, there's a shadow and I can't point at it but you can see where that's where the actual monument sign was. [00:23:11] If you see slightly to the right of that you see some circles in the pavement, that's where the gas tanks are. So this site is restricted from the canopy and the gas tanks from actually placing it in any other location. There's some other drawings in your file that show some other options that were considered that were not, they can't be because of the existing site conditions. [00:23:35] This is a representative example of what the sign would look like. It's approximately 8 feet in height and it is about, I'm sorry, 12 feet in height and 8 feet in width. Very similar to the sign that's on the 7-11 on Main Street, it's just slightly higher than that one. [00:24:02] To grant the variance, there are six items that need to be considered. They're listed here. There's no special conditions that exist for the land. There are no specific conditions that result from actions of the applicant. No additional privileges would be granted to the applicant that another individual wouldn't be able to ask for. [00:24:25] Literal interpretation would deprive the applicant of rights commonly enjoyed by other property owners. The variance granted is the minimum variance possible. And last but not least, the variance would not be injurious to the area or detrimental to the public welfare. [00:24:59] The property was adequately noticed by mailings and posting of the site.
