    approved

Council held the second reading of Ordinance No. 2025-2322, repealing obsolete Section 6-31 of Article II of Chapter 6 of the Code of Ordinances regarding toolsheds and utility buildings. Staff explained the 1964 language had been superseded by updates to the Land Development Code and should have been repealed at that time. The ordinance passed 5-0 with no public comment.

[00:24:01] repeal of section 6-31 of the article H of chapter 6 of the code of ordinances. This [00:24:13] is ordinance number 2025-2322, an ordinance of the city of New Port Richey, Florida, providing [00:24:17] for repeal of section 6-31 of article 2 of chapter 6 of the code of ordinances pertaining [00:24:22] to tool sheds and utility buildings, providing for conflicts, severability, and an effective [00:24:26] date. As I'm sure you will all recall from the first reading in 1991, section 12.03.00 [00:24:37] of the city's land development code was updated, and a section related to detached garages, [00:24:45] storage buildings, and greenhouses was effectuated, and as a result of that, the city of New Port Richey was able to provide for repeal of section 6-31 of the article H of chapter 6 of the [00:25:01] code of ordinances. As a result of that, there was old language in tool sheds and utility [00:25:05] buildings that became obsolete, and that was in section 6.31. The purpose of this agenda [00:25:11] item is to remove the language and to thereby repeal the language in section 6.31, tool [00:25:18] sheds and utility buildings, and that's the purpose of this agenda item. As you can see [00:25:30] from the attachment to your communication, if you have any questions related to this [00:25:35] agenda item, please let us know. [00:25:37] Do we have any public comment? Seeing no one come forward, we'll bring you back for discussion [00:25:44] and vote. Do I have a motion? Do I have a second? Do I have a motion? [00:25:56] Move to approve. [00:25:57] Do I have a second? [00:25:58] Second. [00:25:59] Do I have a maker? [00:26:00] No. [00:26:01] Do I have a second? [00:26:02] No. [00:26:03] Anyone else? [00:26:04] Just to clarify, the explanation here is that it's just codifying language to be appropriate [00:26:12] and legal? I mean, a number of people are wondering, what are we doing with the sheds? [00:26:17] Can you speak a little bit to the effect that this action will have? [00:26:23] Yeah, so this was replaced by an ordinance that was adopted in the Land Development Code, [00:26:30] and this in the Code of Ordinances was not repealed at that time and should have been. [00:26:36] The regulations are essentially the same, not exactly, but they were replaced and updated. [00:26:41] And this particular ordinance goes back to 1964, so it was something that clearly needed [00:26:48] to be updated and has been already. That's why this is being repealed. [00:26:52] It just speaks specifically to the locations where they can be placed. [00:27:02] All those in favor, signify by aye. [00:27:04] Aye. [00:27:06] That's 5-0. [00:27:07] Moving on to business items. Board appointment of Donna Penlon-

And she is in attendance [00:27:18] this evening and she has indicated an interest in serving on the Historic Preservation Board. [00:27:24] We have an opening for a two-year term, and she has a great interest in matters of historical [00:27:34] significance and would be a good member on the group. And if you determine it to be [00:27:42] appropriate to assign her a position on the board, her term of office would span through [00:27:49] May 20th of 2027. [00:27:52] Any public comment? Seeing none, we'll bring it back for discussion and vote. [00:27:57] Would you like to speak? [00:28:05] Honorable Mayor, City Council, and City Manager, I would like to take this opportunity- [00:28:16] Hold the mic down just a little. [00:28:18] I would like to take this opportunity to thank you for giving me the chance to serve my community, [00:28:25] my hometown of New Port Richey, on the Historical Preservation Committee. [00:28:31] To me, it's not only a pleasure to serve in this position, but I feel it's a responsibility, [00:28:36] a responsibility to my birthplace to see that our community, that our history, past, present, [00:28:42] and future is preserved for our next generations. [00:28:46] I promise to work diligently with other board members to see that this accomplishment and the [00:28:51] heritage of our beautiful city remains unspoiled, and as we grow more beautiful and offer more [00:28:58] to our community by always remembering our past. Thank you. [00:29:10] Anybody else? Seeing no one else come forward, we'll bring it back for discussion and vote. [00:29:15] Move for approval. [00:29:16] Second. [00:29:17] To the maker. [00:29:18] Welcome. [00:29:19] Thank you. [00:29:20] Thank you. [00:29:21] Yeah, it's very rare that you can read someone's application for a committee and learn a lot about [00:29:27] our history as a city, and your narrative and application did just that. [00:29:32] I think there is a place for people who study our history on the Historic Preservation Board, [00:29:37] as required by the state of Florida, but simultaneously, I think it's more advantageous to our city [00:29:42] that we include those who have been here since, I mean, whose community, whose, excuse me, [00:29:47] whose family has been here longer than we've had asphalt roads. [00:29:52] And so, this is a clear step in the right direction for our Historic Preservation Board [00:29:57] to continue to be an active part of that. [00:30:00] and a legitimate board with a purpose to speak to preserving the [00:30:05] history in our city. So thank you for stepping up. I do appreciate it. Anybody [00:30:10] else? Yeah, I would just add that to the point that Councilman just made. We have [00:30:18] architects and folks who know buildings and saving them and with Ms. Penland we [00:30:24] have memory of our way of life as a city, early days of the culture and the [00:30:34] personality of our city. So I think that it bodes well to put her on the board [00:30:39] and have that diversity. So welcoming her. Anybody else? Yeah, I just want to thank [00:30:47] Donna for stepping up and joining the group and I hope she brings the same [00:30:53] passions of the SOS to this and I hope they don't miss you over there. Thank you [00:30:58] for doing this. I just want to say, not only for all the people that are sitting out here, but the people who are sitting at home, and it's an old line that I love to use and not [00:31:08] only for this one but for the next appointment, is that 90% of the volunteer [00:31:12] work is done by 10% of the people. Be part of the 10%. Thank you, Donna. So all [00:31:18] those in favor signify by aye. Aye. 5-0. Moving on to a board [00:31:24] appointment, Jennifer Hilton to the Culture Affairs. We have a current vacancy [00:31:30] on the Cultural Affairs Committee for a second alternate and Ms. Jennifer Hilton [00:31:39] has indicated an interest in serving and she has met all of the membership [00:31:45] criteria to serve. The seat that is open is for a two-year term, so if you see fit [00:31:53] to appoint her to serve and we're recommending that you do so, her term of [00:31:59] office would span through May 20th of 2027. And I don't know if she's, yes she is

[00:32:04] on down. All right. I figure she's the only one standing. Hello, I'm Jennifer Hilton. [00:32:15] Hello, Honorable Mayor, City Council, and City Manager. I moved to New Port Richey [00:32:23] nine years ago. I'm originally from Nebraska and I bought a house. I live at [00:32:30] 5333 Shaw Street and I took a job and I moved around the state of Florida and I [00:32:37] missed New Port Richey. So I came back with this whole idea to put my roots [00:32:42] down and open a real estate brokerage. So I have a real estate brokerage here, [00:32:47] Artisan Real Estate. The reason it's Artisan is because I also have an art [00:32:53] background, so I've also owned art galleries and I have a degree in art. And [00:32:58] when one of my past real estate customers heard or was thinking of [00:33:05] leaving or, you know, vacating a position at the Cultural Affairs Committee, he [00:33:10] called me and he said, hey, I think you'd be a really great fit for this and I [00:33:15] want to get more involved in my town that I have chosen and so I'm happy to [00:33:20] be here and I'm looking forward to adding some, you know, different energy to [00:33:26] all this fun stuff we're thinking of doing. And that's it. [00:33:31] I like your energy level. Anybody else like to speak? Seeing no one else come down. [00:33:36] Oh, we got someone. Here comes the Cultural Affairs boss. [00:33:42] Hello. Here he comes. [00:33:44] How are you? [00:33:46] Fine, how are you? [00:33:47] Glad to have you. [00:33:48] Thank you. [00:33:49] Please welcome our board. Open arms. [00:33:51] Thank you. [00:33:53] That's all? [00:33:54] That's it. [00:33:56] People taking up too much time already. [00:33:58] I need approval. [00:34:00] I'll second it. [00:34:01] To a maker? [00:34:02] Yes, sir. [00:34:04] Great to have another artist in a soon-to-be art, culture, music, the town [00:34:10] that we're becoming. It's exciting to have all these folks joining and making [00:34:14] it better for us. So I look forward to seeing you again. [00:34:18] Thank you. [00:34:19] Yeah, I mean, one of the biggest decisions you can make in your life is buying a [00:34:23] home, and you're networking and making those connections. And so between that [00:34:27] and the events you've partaken in and the volunteerism you've done with some [00:34:30] of the local community food banks, and just clearly your excitement and energy [00:34:35] for wanting to be on the committee, I think you will be an asset to it, and I [00:34:38] look forward to it. Thank you. [00:34:41] Anybody else? [00:34:42] No, good. Thank you. [00:34:44] Thank you for serving. [00:34:45] Hey, I'm glad you threw an anchor out in Newport Ridge. [00:34:48] Thank you.

[00:34:55] Recommendations for a firm for the RFP 25-012, Disaster Recovery and Debris [00:35:03] Removal Services. [00:35:05] Mr. O'Farrell will handle the presentation on the agenda item. [00:35:08] Thank you, Ms. Nance. [00:35:09] This item, for you to consider, is for the award of RFP 25-012. [00:35:16] Can you hear me now? [00:35:24] Is it on? [00:35:25] Yes. [00:35:26] Okay, thank you. I'm sorry. [00:35:28] This item, for you to consider for approval, is RFP 25-012. [00:35:34] This is for Disaster Recovery and Debris Removal Services for TFR Enterprises [00:35:40] Inc., and to consider for approval to allow staff to enter into an agreement [00:35:46] in accordance with the same terms and conditions as set forth in the RFP. [00:35:52] In addition, staff would request that City Council consider for approval to [00:35:58] allow staff to enter into agreements with Bergeron Emergency Services and [00:36:03] Ceres Environmental Services. [00:36:06] Should RFP 25-012 be utilized as redundancies? [00:36:08] Should TFR Enterprise not be able to fulfill their obligations called out in [00:36:12] the agreement during a major event that we may have? [00:36:17] On March 28, 2025, there were seven sealed proposals that were opened by the [00:36:23] City Clerk's Office. [00:36:24] The seven bids submitted ranged from a low bid of $20,035,000 and $88,225,000. [00:36:36] TFR submitted the low bid, but what we ended up doing was we wanted to take, [00:36:42] and while it was an RFP, we also wanted to review each one of the submissions [00:36:48] and rank each one of the companies to where we could pull out the most [00:36:54] qualified. [00:36:56] So we had four categories that we reviewed. [00:36:59] They were qualifications of the firm, qualifications of their staff, as well as [00:37:05] technical approach, and they were given credit for their cost submission. [00:37:09] In addition to that, staff also contacted the companies and talked with them. [00:37:14] We wanted to make sure that they understood the numbers that they bid in [00:37:18] the process. [00:37:19] These are very large numbers, but as you may be aware, none of the dollar [00:37:25] amounts would ever be utilized or impacted the budget unless we had a [00:37:29] major event. [00:37:30] We had to come to you to ask for approval, and then the City Manager would [00:37:35] implement those emergency policies that we typically follow under the [00:37:41] guidelines. [00:37:42] And so when we did look at TFR, they have over 35 years of experience. [00:37:50] They have never not met their obligations under any of their contract [00:37:56] agreements that they've had in place. [00:37:59] And then we looked at Bergeron as well as Ceres. [00:38:03] Those are two very large national companies that are based out of [00:38:07] Florida to follow as backup. [00:38:10] And so the other thing that I'd like to say, if you remember when we had our [00:38:14] three hurricanes this summer, there was a lot of small municipalities that [00:38:20] were out of luck or they weren't responded to in a timely manner. [00:38:27] These contracts here have time response, liquidated damages, everything [00:38:33] that makes these companies take and have to submit their services as [00:38:38] called out. [00:38:39] And then by having the redundancies, we can still keep in place FEMA [00:38:44] guidelines to where we can give the first company a reasonable amount of [00:38:50] time to respond. [00:38:51] If they don't, we can go ahead and contact the other companies. [00:38:55] They'll respond within 24 hours. [00:38:57] They'll mobilize within 72 to be able to start getting their vehicles and [00:39:02] equipment certified. [00:39:03] And then we will take and have the boots on the ground within 24 hours [00:39:08] after the certification process. [00:39:10] So we feel very confident in these three selections. [00:39:14] And we would ask you to approve those in the order that we've presented. [00:39:20] Any public comment? [00:39:23] Seeing no one come forward, we'll bring it back for discussion and vote. [00:39:28] Move for approval. [00:39:29] I'll second. [00:39:30] Mr. Baker? [00:39:31] Yeah, as we learned, having these companies on standby and ready to go for [00:39:37] a national disaster especially is so very important. [00:39:40] So thank you for getting this done. [00:39:43] To one of the seconds. [00:39:45] Thank you for putting this together, Robert. [00:39:47] It looks really good. [00:39:50] Let's do it. [00:39:52] You were one of the other seconds. [00:39:54] Oh, I didn't second. [00:39:55] Somebody on this side did. [00:39:57] For the amount there, I see that anything would need to be approved. [00:40:02] But this is reimbursable through FEMA if we needed to trigger these agreements? [00:40:07] Correct, it is. [00:40:08] And the reason why these are such large numbers is you can imagine the [00:40:12] different types of equipment that these companies have. [00:40:15] And so we have to do the RFP process so that depending on what type of [00:40:19] disaster, because it may not be a hurricane, we maybe have to use [00:40:23] different types of equipment. [00:40:25] And we need prices on all of that. [00:40:28] All those in favor, signify by aye. [00:40:30] Aye. [00:40:31] That's five nothing.

[00:40:33] Moving on, recommendations for RFP 2509, unarmed, unfounded licenses, [00:40:42] Class D security service for the city parking garage. [00:40:47] Yes. [00:40:48] And Chief Cochin will advance the agenda item and present it to you. [00:40:52] Thank you, Ms. Manz. [00:40:54] Mayor, council members, the request before the city council is to [00:40:57] consider awarding RFP 2509 to Goddard World Security, or GWS, to [00:41:03] provide unarmed, uniformed, licensed Class D security services for our [00:41:07] city's parking garage. [00:41:10] The request before the city council is being asked to approve the [00:41:12] attached three-year security services agreement with GWS. [00:41:16] On February 9, 2025, RFP 2509 was advertised for unarmed, uniformed, [00:41:22] licensed Class D security services for the city parking garage. [00:41:26] On March 5, 2025, 11 sealed proposals were submitted to the city [00:41:33] clerk's office by the 2 p.m. deadline. [00:41:36] The 11 proposals had bids ranging from $78,000 to $140,400, with the [00:41:42] lowest bidder of $78,000 and the second lowest bidder of $87,204, [00:41:48] not adhering to all the requirements of RFP 2509. [00:41:53] Staff conducted a thorough valuation process, we did our due diligence, [00:41:57] of the 11 bids that considered the following. [00:42:00] Proposals adherence to the bid requirements of RFP 2509, obviously [00:42:05] that's very important, price, very important, approach to security [00:42:09] services, experience and qualifications, full scope of services, and [00:42:14] insurance and bonding. [00:42:16] GWS, a recognized global security corporation with Tampa Bay Area- [00:42:21] based operations out of St. Petersburg, Florida, submitted a complete [00:42:25] bid in the amount of $95,312.12 for annual security services for our [00:42:32] parking garage, which put them at number 3 out of 11 based on price. [00:42:36] However, when we factored in all of the above review criteria, GWS [00:42:41] stands out as the preferred choice. [00:42:44] GWS and staff worked on a 3-year contract for parking garage security [00:42:48] services, which is in line with industry standards for government [00:42:52] entities. [00:42:53] In years 2 and 3 of the contract, GWS will increase the annual pricing [00:42:58] by 3.5%, which is standard for GWS government contracts. [00:43:02] City Attorney Tim Driscoll has reviewed the contract and approved it [00:43:05] as the form. [00:43:07] A recommendation from staff is that the City Council award RFP 2509 to [00:43:11] GWS and allow staff to enter into a 3-year contract service agreement [00:43:16] with GWS for parking garage security services. [00:43:19] If approved, GWS is expecting to start services on June 20, 2025. [00:43:24] The City's parking garage structure is funded by the Community [00:43:28] Redevelopment Agency, CRA, as a transfer to the general fund. [00:43:32] Funding for the GWS contract is allocated in account 00114-43474 for [00:43:36] FY 2025. [00:43:39] And I'm here to answer any questions that you may have. [00:43:45] Do we have any public comment? [00:43:48] Bring it back for discussion and vote. [00:43:52] Move to approve. [00:43:54] I'll second. [00:43:55] Mayor Maker? [00:43:56] Yeah, thanks for including the account numbers. [00:43:58] And just a technical question, the CRA is not paying for this [00:44:08] whatsoever, or was this CRA funds that were transferred? [00:44:11] The CRA does pay for it in the end, but we pay for it out of the general [00:44:15] fund. [00:44:16] That's why it's on your City Council agenda. [00:44:18] But we'll transfer money from the CRA later. [00:44:22] To pay for the expenditure, it should additionally be noted that the [00:44:29] Comfort Inn and Kaiser University also contribute towards the payment [00:44:35] for this expense. [00:44:37] Well, that's a great mention. [00:44:38] I like hearing that part. [00:44:39] Great. [00:44:43] Anybody else? [00:44:44] Nothing for me, Mayor. [00:44:45] Anything else? [00:44:46] All good? [00:44:47] All those in favor, signify by saying aye. [00:44:49] Aye. [00:44:50] That's 5-0. [00:44:51] Planning and Development Department, addition of a department clerk

Planning & Development Department - Addition of a Development Clerk Position and Corresponding Budget Amendment

    approved

Council approved adding a full-time Development Clerk position in the Planning & Development Department, converting an unfilled part-time planning intern position, with a budget amendment of approximately $11,020 for the remainder of the fiscal year. Funds are being transferred from existing unfilled positions and residual funds, not increasing the overall departmental budget. Discussion included concerns about tracking which positions funds are pulled from and statutory restrictions on building permit revenue use.

[00:44:55] position. [00:45:00] Corresponding budget amendment. Yes sir, the purpose of the agenda item is to [00:45:06] request your permission to convert an existing part-time position to full-time [00:45:15] and it would require also a budget amendment and the reason that we're [00:45:22] doing that I'm going to let Mr. Hall talk about it because it is in the [00:45:27] planning and development department and he can provide the justification for it [00:45:33] but I I do want to mention as part of this that it's also prompted on a [00:45:41] retirement that's due to occur in his department as well so with that Mr. Hall [00:45:48] I'll let you lead off [00:45:57] is it on yet there we go okay we're basically requesting to add this [00:46:04] position at this time to allow the planning and development department to [00:46:08] address development activities in efficient and expeditious manner we have [00:46:13] the need for this due to the following we have a continued increase in the [00:46:16] residential and commercial growth in the community we have increased permitting [00:46:20] due to redevelopment for hurricane damaged homes we have increased [00:46:26] permitting due to areas we have currently annexed we have a reduction to [00:46:31] the amount of current of the staff in the future we anticipate some [00:46:36] retirements in the near future and next year and we need some succession [00:46:41] planning due to the pending retirements and we also have a lot of overtime going [00:46:46] and we want to try to you know even that out between the staff members it's [00:46:51] important to note that we currently have a development tech a senior [00:46:57] development tech a part-time development tech which also does our BTRs business [00:47:02] tax receipts and then a part-time development clerk that is the front [00:47:07] receptionist so this would be in addition of a development clerk that we [00:47:11] could bring it at this time and cross-train with the existing staff to [00:47:15] help us keep seamless in the issuance of permitting in the near future and in [00:47:23] the upcoming year I can go into more detail if you wish and the budget [00:47:30] amendment that we're asking for the remainder of the fiscal year is [00:47:35] $11,020 I believe it's eleven thousand two hundred around that [00:47:41] thank you yeah and and the important thing to note on that one is the money [00:47:45] is currently in our budget but it's in other positions that aren't currently [00:47:50] filled at this time so there's not an increase in our departmental budget it's [00:47:54] transfer of funds within the budget every public comment see no one come [00:48:00] forward bring it back for discussion vote to approve I'll second the maker [00:48:07] yeah two questions the first one is so I know you listed a a list of several [00:48:13] reasons for the need and I couldn't agree more that there is a need it pains [00:48:18] me every time I drive by on a Saturday at 6 p.m. and I see lights on in the [00:48:23] development office and so they are working on a lot of overtime I imagine [00:48:28] maybe not literal overtime but that being said is this something that we [00:48:34] anticipate just being going forward or is this a hurricane thing that [00:48:38] potentially in a year or two is going to be phased out I could say it's hard to [00:48:43] say what the future will hold with planning and development but we're [00:48:46] asking that for this fiscal year and when we go into the budget season we'll [00:48:50] reassess and ask for what we need for next year my second question is you did [00:48:58] bring up that the possession the position is being covered through funds [00:49:02] in-house budgeted elsewhere I think this is the second request this year that has [00:49:07] come for before us for a position don't don't hold me to this I think that other [00:49:13] one was from the human resources department where other positions were [00:49:17] mentioned as being unfilled and so the money was being taken from there as the [00:49:23] council sets the budget and direction if we have positions that are not being [00:49:27] filled the plan was you have those positions filled for certain whatever [00:49:32] operations the director or directors had in mind and so if that vision has [00:49:38] changed if the plan has changed for that department or there's a service that's [00:49:41] not being filled I think it's worthwhile to list or at least tell us what [00:49:46] positions are being pulled from so that we know where the budget stands I think [00:49:51] there was a larger conversation about some financials and numbers and and so [00:49:57] for me for example you mentioned it but reading this and the homework I did on [00:50:01] this it doesn't mention what we're losing out on similar to how the human [00:50:06] resources position I don't know where what positions were unfilled that we [00:50:10] didn't have so in response to the point that you're making in the development [00:50:18] department it's a planning intern and it is indicated in the memo and in the case [00:50:25] of the human resources department there wasn't a position that was that we [00:50:31] weren't filling so just to be clear because the request says that you're [00:50:36] upgrading position and then later on you're saying you're taking a vacant [00:50:40] position so those are the that's referring to the same thing we're [00:50:45] changing an existing planning intern position into a development clerk okay [00:50:51] and so we haven't hired for that position so that's the intern position [00:50:55] that's being okay second good second have a second thanks for putting this [00:51:05] together Dale we definitely do need help in the planning department I go in there [00:51:09] often and it's usually a line so I think some more help would be great for your [00:51:14] staff and to cut down on some overtime so good so mr. mayor the only comment I [00:51:23] want to make is to recognize as we look at different positions and where the [00:51:29] money is coming from that the planning department is draws from its own fees [00:51:36] and its fee structures for planning so hopefully you know those fees are [00:51:41] sufficient to cover we're in other things like police or fire or other [00:51:46] services we're we're dependent more on general taxes so it's also where the [00:51:50] money's coming from and to that point you mentioned permits and I'm very in [00:51:58] tune to the statutory requirement that revenues that are generated by building [00:52:02] permits have to be used within that division and reported in that fashion [00:52:09] and cannot be used to pay any other so they're kind of a the building division [00:52:16] I would guess of the planning department is the only area that's covered by that [00:52:20] statutory requirement but not the planners and the builders so when when [00:52:27] you're letting the finance office know or the managers doing her budget there's [00:52:33] an element that has to be done by the auditors to say how much money is coming [00:52:38] in and building permits and if we have excess more than a quarter I think of an [00:52:44] annual budget you have to return it back to the back to the people who pay the [00:52:50] building permits so there's there's additional regulations on the city [00:52:55] related to that so at least two I'm sorry a long question leading to a short [00:53:01] answer which is this position is identified as a planner but then you [00:53:06] commented about permits so how do you delineate between the work you're doing [00:53:11] related to permits and the work you're doing related to planners this is a [00:53:16] development clerk position in permitting it's not a planner position [00:53:20] the planner is separate we have permitting zoning and building basically [00:53:25] three different divisions this is in the permitting section which is also [00:53:28] building right so this to my point pay for this is coming from building permits [00:53:34] directly and so if the funds are available based on your building permit [00:53:39] income you have to keep track of that balance that retained amount so I think [00:53:45] it's probably about as safe a place as you can come to us and ask for money if [00:53:49] the money is there to pay it my point mr. mayor if I can I just don't feel [00:53:53] like I I got a full answer to my question and based on what was just [00:53:56] brought up there again the request says an existing part-time planning intern [00:54:02] position but the NAND says various not one various vacant position savings so [00:54:07] can we clarify how many positions this is pulling from it will also it also [00:54:14] refers to a retirement that is due to occur at the end of the fiscal year in [00:54:20] his department because it's just it's not mathing for me if you have an [00:54:25] existing part-time playing intern position that's budgeted for and now [00:54:28] you're upgrading that position a full time and saying you're using that intern [00:54:32] position to pay for that where's the additional money coming from we're only [00:54:36] asking for money through the end of this fiscal year and that is the $11,000 we [00:54:43] haven't budgeted at all okay for into the next fiscal year and the next year [00:54:48] where this will be a full-time right okay if I can clarify a couple things [00:54:53] one is the planning intern position is a part-time position okay that hasn't been [00:55:00] filled through the year it's very hard to fill a planning position we also are [00:55:05] looking at residual funds that are available unfortunately from a passing [00:55:13] of a one of our staff members so there is finances in that position also that [00:55:20] is we could utilize for covering of this position and we're anticipating using [00:55:26] using some of that so it's a part-time intern and then the other position [00:55:31] that's left over that hasn't been filled and we hope to fill soon but not [00:55:35] yet and none of the planning intern money to councilman Altman's point the [00:55:41] planning intern position money none of that was related or held down by [00:55:45] permitting that was budgeted money that's not connected to permitting [00:55:49] revenue not not to muddy the waters this is a planning and development department [00:55:53] we have building permit fees we have zoning permit fees we have a lot of [00:55:58] permit fees so the permit fees go to pay for the positions within the [00:56:04] department it's not though we have enough money within the whole department [00:56:10] to pay for what we need I beg to say that you did muddy the waters in my mind [00:56:17] so let me just stir it up a little bit more then so from a budget standpoint I [00:56:24] understand what you're saying you were the department head our city allows the [00:56:27] budget to be moved within the department without having to have a [00:56:31] amendment even and so well explained however you don't use money from [00:56:39] planning to pay for permitting when you need to have all the expenses in the [00:56:44] permitting division building division to satisfy this floor of statutes related [00:56:49] to the return of excess money so when we have a lot of business and this is [00:56:54] happening in other cities and they have an excess money that's left in that [00:56:58] component of your department then they have to spend it or give it back so [00:57:04] that's not your role that is crystals role probably and the auditors so I'm [00:57:11] not taking exception to what you're saying but you're explaining how you [00:57:15] have money in your department budget the real bottom line is this money is coming [00:57:20] from building permits and building permits should not be used to pay for [00:57:24] any planning activity so that's a legal issue at which I'm sure our attorney can [00:57:30] look up and you can talk about and not one to correct but only I'm just trying [00:57:34] to inform to make sure I'm that I do think that you're aware of it yeah but [00:57:40] it goes back to his point so you keep bringing up things I'm gonna keep [00:57:43] replying yeah all those in favor signify by aye those opposed it's five [00:57:52] nothing communications will start with you Pete okay so thank you I just came
