approvedCouncil held first reading of Ordinance 2024-2303, amending Chapter 22 of the Land Development Code regarding flood damage prevention. Key changes require manufactured homes in special flood hazard areas to be elevated to base flood elevation plus one foot, and require foundations for one- and two-family dwellings in flood hazard areas to be designed by registered design professionals. [00:05:41] Public reading of ordinances. [00:05:43] First reading of ordinance 20, 24-20, I thought maybe it's, [00:05:49] took the hammer away from me, 20, 23, 2303. [00:05:53] Amendments to the chapter 22 of the code of ordinances, flood damage protection. [00:06:00] This is ordinance number 2024-2303, an ordinance of the city of New Port Richey, [00:06:04] Florida, providing for amendment of chapter 22 of the land development code. [00:06:08] Pertaining to flood damage prevention, providing for [00:06:10] amendment of section 22.0200, pertaining to an updated flood insurance study. [00:06:15] Providing for amendment of section 220502, pertaining to standards and [00:06:20] flood hazard areas without base flood elevations. [00:06:24] Providing for amendment of section 220705, [00:06:27] updating the Florida building code reference. [00:06:29] Providing for amendment of section 22.0904 pertaining to [00:06:32] definitions of terms used in the flood regulations. [00:06:36] Providing for amendment of section 22.0100, providing for building code amendments. [00:06:41] Providing for amendment of section 22.1201 pertaining to compensatory fill. [00:06:46] Providing for amendment of section 22.1206 pertaining to [00:06:49] exemptions on placement of fill in flood areas. [00:06:53] Providing for amendment of section 22.1300 pertaining to elevation [00:06:58] of manufactured homes in flood areas. [00:07:01] Providing for amendment of subsection 5 of section 22.1601 pertaining to [00:07:05] additional elevation of mechanical, plumbing, and electrical systems in flood [00:07:09] areas. [00:07:10] Providing for a new section 22.1800 pertaining to prohibition of hazardous [00:07:15] materials. [00:07:16] Providing for severability, providing for conflicts, providing for [00:07:19] codification, and providing an effective date. [00:07:23] Yes. [00:07:24] Thank you, Mr. Mayor, members of the council. [00:07:28] As you'll recall from previous discussions, the city participates in [00:07:33] the National Flood Insurance Program. [00:07:35] And in that respect, we also participate in the community rating system, which [00:07:41] is a voluntary incentive program that recognizes and encourages [00:07:48] communities' floodplain management activities so that we can pass along [00:07:59] discounts and insurance policies through premium discounts for citizens that [00:08:08] have to purchase flood insurance policies. [00:08:13] One of the ways that we can do so is to institute an ordinance such as the one [00:08:21] before you this evening, and what we are specifically mandating in this [00:08:29] ordinance are two things. [00:08:33] One, that if a manufactured home is installed or placed in a special [00:08:38] flood hazard area, it must be elevated to at least the base flood elevation [00:08:43] plus one foot, which necessitates modification to the existing requirements. [00:08:51] And two, which is an existing requirement, but it is not written in an [00:08:58] ordinance, is that we have to require all foundations that are for one family [00:09:08] or two family dwellings in flood hazard areas to be designed by registered [00:09:13] design professionals. [00:09:17] And there are also some language changes that have been made in the [00:09:24] ordinance that are less significant, but those are the most significant areas [00:09:35] of the ordinance that I needed to point out to you. [00:09:42] The Land Development Review Board did consider these changes at a meeting that [00:09:50] they conducted in June on the 27th, and they recommended unanimously in favor [00:09:56] of making these changes to the ordinance, and they're recommending that you [00:10:03] consider them favorably as well. [00:10:10] And the redline version of the ordinance is attached to your agenda item. [00:10:19] Thank you. [00:10:20] We have any public comment? [00:10:21] Seeing no one come forward, we'll bring it back for discussion and vote. [00:10:30] Do we have a motion? [00:10:31] Everybody still reading it? [00:10:32] Move for approval. [00:10:33] Second. [00:10:34] Comments? [00:10:35] For discussion? [00:10:36] Yes. [00:10:37] No? [00:10:38] All right. [00:10:39] Yeah, anybody have any... [00:10:40] Yeah, no asking of you. [00:10:41] All right, no, I'm fine. [00:10:42] Okay. [00:10:43] I was doing it for purposes of having a discussion. [00:10:44] I accept that it's a recommendation, and it's logical to make the changes that have been [00:10:56] proposed. [00:10:57] Yeah, to the point, it's a good recommendation. [00:11:01] LDRB approved it, and I mean, it's staying consistent with the goal that we're marketing, [00:11:06] which is getting that flood right down, so... [00:11:09] I agree. [00:11:10] I'm good. [00:11:11] Yeah. [00:11:12] Exactly what you said doesn't need to be repeated. [00:11:15] All those in favor signify by aye. [00:11:17] Aye. [00:11:18] Aye. [00:11:19] Those opposed? [00:11:20] We have five nothing. [00:11:21] I'm moving on to business items.

[00:16:05] supervisor's recommendation in which he's identified seven vehicles [00:16:11] and equipment, which we wish to declare as surplus equipment [00:16:15] and authorize staff to process the vehicles and equipment for auction [00:16:20] using the services of the public, group LLC, and Robert Rivera. [00:16:27] Do you have some additional comments on the agenda item? [00:16:32] Just to add, the vehicles are between 23 and 10 years old. [00:16:36] We've got one police patrol vehicle and six public works maintenance [00:16:40] trucks, most of them are the dump trucks. [00:16:42] The auction house has the buyer's pay, [00:16:48] the 7% surcharge, so the city's not involved in any kind of money [00:16:53] transaction other than receiving the funds. [00:16:55] And, of course, those funds that we do receive are considered revenue [00:17:00] dollars for the city. [00:17:02] So with that, we would recommend approval. [00:17:06] Do we have any public comment? [00:17:08] Yes. [00:17:09] I have questions. [00:17:17] Okay, you mentioned that there were some automobiles that were for sale. [00:17:23] Mr. Mayor, is it appropriate for her to ask questions? [00:17:26] He's the only one who has the answers. [00:17:28] No, no, excuse me, excuse me. [00:17:29] You're addressing the council. [00:17:30] Okay. [00:17:31] We'll help you. [00:17:32] All right. [00:17:33] Then you need to ask Robert Rivera what cars are available for sale [00:17:37] and the address of the auction house. [00:17:39] Get that information afterwards, [00:17:41] because we don't have that up here at the present time. [00:17:43] Well, that's why I'm asking him. [00:17:44] You can talk to him after. [00:17:46] You can address. [00:17:47] All right. [00:17:48] So you're letting him give you that. [00:17:49] Excuse me. [00:17:50] I wanted to go over the camera so that the public. [00:17:53] Ma'am, excuse me. [00:17:54] Excuse me. [00:17:55] Excuse me, ma'am. [00:17:56] You can approach the city manager. [00:18:00] She'll give you the list after the meeting. [00:18:02] That's not open to the public, though. [00:18:04] We need to know where the auction house is [00:18:06] and when it is so that it is public information [00:18:10] so the public can go to the auction. [00:18:12] It's listed in the packet. [00:18:14] What packet? [00:18:16] The packet's available online for this meeting. [00:18:19] Okay. [00:18:20] Thank you. [00:18:21] Any other public comment? [00:18:24] If not, I'll bring it back for a vote and discussion. [00:18:27] I'll second. [00:18:30] Do you have anything else? [00:18:33] I mean, better to sell it and get some money back out of it. [00:18:36] I just want to take this moment to remind staff that I did make a request in private [00:18:39] at the start of my term if we could get a book, [00:18:44] the one set of the binder in the front. [00:18:47] That way if someone has questions about it, they can go to it, take a photo. [00:18:50] So I don't know if we've made any progress on doing that [00:18:53] or whether that's in the interest of the council to prepare one of those agenda packets [00:18:58] to be sitting in that front table so people can purview through it. [00:19:01] I think staff would be believing it. [00:19:05] I mean, sometimes there's a couple hundred pages. [00:19:08] So I think that the budget that's listed out there, they can go online and look at it. [00:19:15] And if they want to dig into it, they can dig into this. [00:19:18] I don't really think we need to do a paper. [00:19:20] Anybody else comment? [00:19:23] I mean, however they want to do it. [00:19:25] If they want to put a book out there or they want to do it online, [00:19:28] however they want to do it. [00:19:31] We do have a significantly older population here that doesn't necessarily regularly go to websites. [00:19:38] And to be clear, the packet that's out there says to go to the cityofnewportrichey.org's website. [00:19:45] It does not list where to go, how to do it. [00:19:48] It just says go to the cityofnewportrichey.org's website. [00:19:51] Well, we might be able to expand that a little bit. [00:19:53] I'm fine with changing the language if you prefer that. [00:19:55] But I don't see us taking one of our staff members to sit there and make copies of 200 pages. [00:20:01] Can we amend the language then on there? [00:20:03] Because it does say on here to go to the website, but it doesn't clarify where to go. [00:20:07] Okay. [00:20:08] That isn't a problem with that. [00:20:09] Do you have any problem with that? [00:20:10] No, that's good. [00:20:11] Mayor? [00:20:12] Yes. [00:20:13] Yeah, just a thought. [00:20:14] I mean, in the old days when we did the budgets, or even maybe now still, [00:20:19] there was always big books, large volume, and we always made one available at the library. [00:20:26] So whether or not it's an electronic copy or it's a printed copy, [00:20:32] there's no reason that we couldn't allow for someone to review our books [00:20:38] and have some kind of simple means for the ability to have that done, I'm guessing. [00:20:45] I mean, that's great. [00:20:46] If we did it electronic, and then like Bertel said, [00:20:50] if we did it electronic and then just put where to go find it specifically on the website. [00:20:54] And you could even say the library and one of the library staff can help. [00:20:57] Yeah, one of the library staff. [00:20:58] Yeah, just what's at that verbiage at the bottom of this sheet. [00:21:02] That way we can just say go to the website as opposed to. [00:21:05] Perfect. [00:21:06] You don't like the library? [00:21:08] I'm not allowed. [00:21:10] I can actually check it out. [00:21:11] It's not allowed in the library. [00:21:13] I have some overdue books. [00:21:15] I can't. [00:21:16] All those in favor signify by aye. [00:21:18] Aye. [00:21:19] Those opposed? [00:21:20] Carries five zip.

[00:21:22] Public Works Operations Center, HVAC. [00:21:26] Project close up. [00:21:29] The request is to consider the approval of a final pay request in the amount of $41,250 [00:21:37] and a deductive change order in the amount of $3,750 from Air Mechanical and Service Corporation [00:21:47] as related to the replacement of one 25-ton split system HVAC condensing unit. [00:21:55] Mr. Rivera. [00:21:57] Thank you, Ms. Manns. [00:21:58] The only thing that I want to add to it was this was part of the 2023 Volt Air Consulting Engineers [00:22:05] deficiency analysis of the building. [00:22:08] It was recommended to be replaced. [00:22:10] The additional elements did include some upgrades to the digital controls [00:22:15] and the replacement of the electrical breakers associated with the electrical facilities, [00:22:22] the piping valves that work in dampers. [00:22:25] With that, we would recommend that you do approve the final pay request and the deductive change order. [00:22:33] Do you have any public comment? [00:22:36] Seeing no one come forward, we'll bring it back for discussion and vote. [00:22:40] I move to approve. [00:22:42] Second. [00:22:43] I have no comment. [00:22:44] I'm good. [00:22:45] I'm good. [00:22:47] All those in favor, signify by aye. [00:22:49] Aye. [00:22:50] Those opposed? [00:22:51] Six, five, nothing.

[00:22:52] Ratify the IAFF contract. [00:22:55] Yes. [00:22:56] The purpose of the agenda item is to ask you to consider ratifying the proposed collective bargaining agreement. [00:23:02] Between the city and the International Association of Firefighters, Local 1158, [00:23:08] for the period spanning October 1st, 2023 through September 30th, 2026. [00:23:15] And Mr. Wetzel will present the agenda item. [00:23:19] Thank you, Ms. Vance. [00:23:20] Good evening, Mayor and Councilmembers. [00:23:23] After several months of positive and respectful discussions with the firefighters, [00:23:28] staff is pleased to present to you the proposed final agreement with respect to this collective bargaining agreement. [00:23:34] Following is a brief summary of the terms and conditions that have been agreed upon by the union and the city's negotiating team. [00:23:41] The first item was language. [00:23:43] After a three-year former contract, there's obviously clean-up and updating of the language throughout [00:23:49] that was outdated or no longer in practice, so that was taken care of. [00:23:54] The grievance procedure was, again, we changed some of the language in there to provide consistent language [00:24:00] and increased the number of business days in which to respond to a grievance by five days. [00:24:05] The holidays. [00:24:06] We officially listed the addition of Juneteenth as a holiday in the contract. [00:24:12] The city proposed and, again, was agreed upon to add a city fire safety inspection program. [00:24:18] The city will establish a pilot fire safety inspection program in consultation with the union. [00:24:24] Firefighters will be able to participate in that program. [00:24:27] The city may discontinue that program at its discretion, and that discontinuation will not be grievable. [00:24:36] With regard to personnel practices, updated in there that employees hired on or after October 2nd of 2023 [00:24:44] must obtain a state of Florida paramedic certification within three years of their date of hire. [00:24:50] The fire chief may grant an extension of up to one additional year at their discretion. [00:24:55] However, the denial of the extension shall not be grievable. [00:24:59] With regard to seniority, layoffs, and recall, we had language to bring consistency of layoff [00:25:05] and recall notice language to reflect the same number of days for each to be 10 business days. [00:25:11] Hopefully, we'll never have to utilize that. [00:25:14] With regard to leave of absence, we agreed to increase the designated union representative time off [00:25:20] to deal with union business, conferences, and trainings from 24 hours to 72 hours of duty hours per fiscal year. [00:25:28] And a uniform issue, the fire chief may allow a member who achieved normal retirement [00:25:32] to keep their city-issued helmet upon retirement. [00:25:36] With regard to the wages, probably the key element in there, for the year 2023, [00:25:43] we agreed to a 5.5% increase to the contract and to the overall contract from that standpoint. [00:25:53] It will also still allow the step increases within the program that we have established. [00:25:58] That takes care of the year 2023. [00:26:00] There will be re-openers for wage discussions in the year 2024 to 2025 and in the year 2025 to 2026. [00:26:08] Again, the recommendation from staff to city council is to vote in favor of the terms and conditions [00:26:16] as identified in the proposed labor agreement that is in your packet and just briefly discussed here. [00:26:25] Do we have any public comment? [00:26:29] Bring it back for a vote and discussion. [00:26:32] I move to approve. [00:26:33] Second. [00:26:34] Yes, so the economics here look really good. [00:26:36] And you can tell Mr. Wetzel and Ms. Manns acted in good faith [00:26:42] and were good brokers of the city's obligation to taxpayers [00:26:46] in addition to making sure we are serving our firefighters and doing right by them. [00:26:51] There's an increase in here. [00:26:52] There's opportunities for re-openers. [00:26:54] I didn't realize there would be a lot more to include beyond the economics, [00:26:57] but we managed to add in a lot of language that benefits them. [00:27:01] So I'm very proud of the work that the staff did for this. [00:27:04] So thank you for getting it done. [00:27:07] Yeah, I think the negotiations went well, that both sides are in agreement. [00:27:11] That looks good. [00:27:14] As far as the increases, I mean, we have to stay competitive with everyone else. [00:27:19] So we'll make sure we're retaining good people and attracting them also. [00:27:27] I'm fine with it. [00:27:29] Hey, we got it done before the end of the year, [00:27:31] which is surprising sometimes in the years I've been here. [00:27:34] Thank you very much, staff. [00:27:36] All those in favor, signify by aye. [00:27:38] Aye. [00:27:39] Those opposed, it's 5-0. [00:27:41] I'm going to hold communications to the end of the next meeting
