[00:00:37] The next item, actually the only significant item on the agenda, is a business item. [00:00:43] Request to participate in the Florida Settlement with Telva, Allergan, and CVS. [00:00:50] Back in May of 2021, the state of Florida was, I'm sorry, the city entered into a memorandum of [00:01:02] understanding regarding the national prescription opiate litigation, and the MOU set forth a [00:01:13] non-binding general framework, which was responded to earlier this year, and the state of Florida [00:01:23] was allocated approximately $1.6 billion from the historic Big Three distributor. [00:01:32] The good news is that the city was notified earlier this month that a proposed settlement had been [00:01:40] reached with Telva, Allergan, and CVS, and that the proposed settlement comprised of both cash and [00:01:50] product intended to combat the opiate crisis in Florida. [00:01:56] The amount of the total settlement is just over $166,165. [00:02:06] The bad news is that it's scheduled to be paid out over two different schedules, one scheduled over 11 years, [00:02:14] the other over 18 years, so the expenditures are spread over a fairly long period of time. [00:02:24] The types of items that are eligible to be paid for with the funding are care and treatment, [00:02:32] and other programs and expenditures that are intended to either address the misuse or the abuse of opiate products, [00:02:42] and to treat or mitigate the disorders of the alleged, or other alleged disorders as a result of the opiate crisis. [00:02:55] The purpose of this agenda item is to request that you authorize that the city manager may execute the subdivision [00:03:06] settlement participation forms and any other documents as necessary related to the settlement of this suit, [00:03:18] and the city attorney and I are prepared to respond to any questions that you may have in this respect related to the [00:03:28] settlement agreements, of which there are three settlement agreements and three settlement participation forms [00:03:37] attached to this agenda item, which have been reviewed, and we're recommending approval. [00:03:44] Thank you. We'll open it up for public comment. [00:03:47] Seeing no one rushing down here to publicly comment, we'll bring it back to council. [00:03:55] Move for approval? [00:03:56] I'll second. [00:03:57] Maker? [00:03:58] Yeah. [00:03:59] Second? [00:04:00] No, I mean, there's a lot of things we could talk about about this, but it seems like the horse is out of the barn, I guess, on this one, [00:04:11] so we might as well make the least resistant, because fighting on our own would be expensive. [00:04:24] Councilwoman? [00:04:27] Deputy Mayor? [00:04:28] Is there any necessary reporting forms as far as once the money's received, expenditures, and how it's spent? [00:04:35] Is that part of the settlement? [00:04:37] We will have to account for the expenditures. [00:04:40] I should also note that we are allowed to buy supplies, and Narcan is one of the supplies that will be provided as part of the [00:04:49] settlement agreement. [00:04:51] So the settlement agreement is money over those years. [00:04:53] There's no interest applied to that over those periods, just those years divided, right? [00:04:58] I don't believe there's any interest involved, no. [00:05:01] Thank you. [00:05:06] It's a shame that it's spread out over quite so far, but it's $166,000 plus that can go towards help cover some of the costs that [00:05:16] we're incurring because of the malfeasance of the opioid industry. [00:05:25] Any further discussion? [00:05:27] Hearing none, all those in favor, please signify by saying aye. [00:05:31] Aye. [00:05:32] Opposed, like sign. [00:05:33] We have a regular meeting coming up next Tuesday. [00:05:36] Does anybody have any communications they want to do tonight? [00:05:42] Seeing none, I... [00:05:43] I've got one comment I'd just like to maybe pass along. [00:05:49] Recently I had an opportunity to attend an LDRB meeting, and I've reviewed some of the minister meetings that's been occurring [00:06:01] recently in the past few months. [00:06:04] But I've seen one kind of recurring subject that comes up, and I just thought it might... [00:06:13] It's perked my interest, and I just thought I'd share it with you as far as my observations and what I see. [00:06:18] And that is it has to do with... [00:06:21] It seems we're constantly having some kind of review or request to get a variance on docs, particularly. [00:06:36] And we've had a number of those this year, and there's still some, I think, on the docket coming up. [00:06:41] And I think what generates it a little bit is I think it's just part of our economy [00:06:46] and what we're seeing as far as people buying bigger boats, and some people buying more boats. [00:06:56] And I think they're just really pushing on the edge of what our current ordinances has as far as setbacks [00:07:07] and positioning of docks and far out in the river and all that. [00:07:11] They're pushing on that. [00:07:13] And recently I think there was one individual who got approval to have a double dock on his property. [00:07:21] So now it's one or two lifts that come out into the river. [00:07:25] And I just have a... [00:07:28] And just my observation of watching boat traffic and these things happening, [00:07:32] I'm just wondering if it might be a time that we maybe take a peek at our ordinance [00:07:38] and make sure it is as good as it needs to be. [00:07:43] And if we see that there might be some things we might need to change just to preserve our waterfront. [00:07:56] I don't know if we might want to put a... [00:08:00] If we think that that work needs to be done, maybe put a halt on any variances until that's completed [00:08:08] just so nothing gets snuck by or anything like that. [00:08:11] I just wanted to share that with you as my observation. [00:08:15] I haven't done a lot of studying in it, [00:08:17] but I have witnessed a couple of variances for docks and we need a couple of others. [00:08:25] So I just wanted to share that with you guys. [00:08:27] I don't know if anybody else has any thoughts on that. [00:08:32] I would just say if we're getting a lot of variances on it, [00:08:36] then yeah, probably something we need to look at. [00:08:38] I mean, variances are there for special things or special conditions to get approved. [00:08:45] But if everything's coming through as a variance, then we probably need to look at it, definitely.
